Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records on the file of the first respondent herein in Ref:No.10663/E2/1/2007-II dated 21.11.2011 and the proceedings of the second respondent herein Ref. No.15000/E2/3/2011 dated 30.12.2011, to the limited extent of noninclusion of the name of the petitioner in the panel issued therein and to quash the same and to direct the second respondent herein to include the name of the petitioner in the above mentioned panel for promotion to the post of office Superintendent for the year 2011-2012 and to promote him with retrospective effect from the date of promotion of his immediate junior and to grant him all consequential benefits.

This writ petition is filed challenging the charge memo dated 21.11.2011 issued by the first respondent and consequential order of the second respondent dated 30.12.2011.

Today, when the matter is taken up for hearing, the learned Government Advocate appearing for the respondents submitted that the very charge memo has been dropped and subsequently, the petitioner was considered and promoted to the post of 'Superintendent' and also promoted further to the post of 'Administrative Officer'. Therefore nothing survives for further adjudication in this writ petition. 3.

Recording the submission made by the learned Government Advocate appearing for the respondents, this Writ Petition is dismissed as infructuous. Consequently, connected Miscellaneous Petitions are closed. 2/4
