Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the respondents recruitment notification in NO.01/ DMA / Recruitment / 2024, dated 02.02.2024 and quash / revoke the same as illegal or to rescind the educational qualification as Must posses as B.Sc. degree in Zoology allied with chemistry or chemistry allied with Zoology or B.Sc. degree in Public health or Environmental Science or Microbiology or Bio- Chemistry and Must have completed Sanitary inspector course from any institution approved by the Government of Tamil Nadu or directing the respondents to permit the petitioner to participate in the Recruitment to the post of Sanitary Inspector in pursuance to the Notification NO.01/ DMA / Recruitment / 2024,dated 02.02.2024 issued by the Municipal Administration and Water Supply Department by treating the educational qualification possessed by the petitioners i.e. B.Sc., (Chemistry) with sanitary Inspector course as 2/7

eligible qualification for the post of sanitary Inspector within the time period stipulated by this Hon'ble court.

For R2 to R7 : Mr. C. Selvaraj Additional Government Pleader COMMON ORDER These Writ Petitions have been filed in the nature of a certiorarified mandamus seeking records relating to recruitment notification in NO.01/ DMA / Recruitment / 2024, dated 02.02.2024 and to quash the same.

2. The petitioners are aggrieved by the stipulations of the educational qualification that the candidates must possess B.Sc. Degree in Zoology allied with Chemistry or Chemistry allied with Zoology or B.Sc. Degree in Public Health or Environmental Science or Microbiology or Bio- Chemistry. It had also been stipulated that the candidates must have completed Sanitary Inspector course from any 3/7

institution approved by the Government of Tamil Nadu. The matter had come up for consideration on 24.02.2025.

3. In the affidavits filed in support of these writ petitions it had been stated that the petitioners had completed B.Sc. Chemistry. However, in the notification, which is now questioned, it had been stated that the candidates must have possessed B.Sc. Chemistry allied with Zoology. It had been stated that the petitioners have not obtained that particular qualification. The petitioners have not even applied for the post.

4. It is contended on behalf of the respondents that the recruitment process proceeded further and the recruitment itself had been completed. At this stage, it would be extremely difficult to revisit the qualification as prescribed in the notification. When the petitioners are not eligible to apply, then, they cannot question the notification that alternative qualification must be prescribed in the notification to enable them to apply and participate in the recruitment process. The petitioners had also not applied for the post. Hence, they have no locus or jurisdiction or authority to question the notification.
