Criminal Original Petition has been filed under Section 482 of Cr.P.C, praying to call for the records pertaining to the case in C.C.No.444 of 2020 pending trial on the file of the learned Magistrate, Fast Track Court - I, Coimbatore, quash the same by allowing this quash Petition.

ORDER

As per the Order passed by this Court in this case dated 12.03.2021, the learned Judicial Magistrate, Fast Track Court -I, Coimbatore District was directed to dispose of the case in C.C.No.444 of 2020 within a period of three months from the date of receipt of a copy of this order.

2. In continuation of the same, the learned Judicial Magistrate, Fast Track Court -I, Coimbatore District had sought further time of six months to complete the case.

3. Further it is found that the Accused had absconded and Warrant pending against him. The learned Judicial Magistrate shall prevail upon the Police Officials concerned to execute the Warrant so as to enable the Court to dispose of the case. The learned Chief Judicial Magistrate is also directed to prevail upon the Commissioner of Police or Superintendent of Police of Coimbatore Rural to execute pending Warrant to enable the trial Court to dispose of the case without any delay. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Judicial Magistrate, Fast Track Court - I is advised that when the Accused is produced on execution of Warrant, he shall be detained in Prison till the disposal of the case in C.C.No.444 of 2020. He shall not be released on bail as he had violated the Orders of this Court. Therefore, the learned Judicial Magistrate -I, Fast Track Court is directed to dispose of the case within the extended period of six months and to report compliance.
