This petition is filed to condone the delay of 103 days in filing the appeal.
Heard Mr.C.Paraneedharan, learned counsel for the petitioner and Mr.S.Vadivel, learned counsel for respondent 1.
Since the owner of the vehicle, ie., respondent 2, is no more and the main appeal has been filed against the quantum that has been fixed by the Tribunal as compensation payable by the Insurance Company, the main contesting respondents 3 to 5, since have been served and there is no representation to that effect before this Court despite the names and addresses being printed in the cause-list, having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 103 days in filing the appeal is condoned.
Accordingly, the petition stands ordered.
