The petitioner, who was arrested and remanded to judicial custody on 12.12.2021 for the alleged offence under Sections 8(c) read with Section 22(c) and 29(1) of the NDPS Act 1985 in Cr.No.1166 of 2021 in C.C.No.122 of 2022 on the file of the learned Principal Special Judge(EC & NDPS Court) at Chennai seeks bail.

2.The case of the prosecution based on the confession of the other accused the petitioner is implicated in this case. It is alleged that petitioner along with other accused were found in illegal possession of 27 LSD Stamp. Hence the case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he is in judicial custody for more than one year. He further submits that he is ready and willing to abide by any of the stringent conditions imposed by this Court. Hence prays for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) submitted that the petitioner along with other accused were found in possession of 27 LSD Stamp. He also submits that this is the second bail application and there is no change in circumstances. Hence, he opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and the quantity involved is the commercial quantity and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. The Trial Court is directed to dispose of the case, within a period of six months from the date of receipt of copy of this order. 02.03.2023 Jai
