This petition has been filed seeking to condone the delay of 212 days in filing an appeal in Crl.A.SR.No.96586 of 2025.

2. Learned counsel for the petitioner submitted that the petitioner/de facto complainant is the mother of the victim, who is mentally challenged and since the petitioner was preoccupied with caring for her daughter, she was not able to file the appeal within the limitation period. He further submitted that the 2nd respondent/accused committed rape against the victim, which is a heinous offence. Accordingly, he prayed for allowing this petition.

3. Per contra, Mr.C.Prabakaran, learned counsel appearing for the 2nd respondent, filed a counter affidavit stating that the petitioner has miserably failed to explain the delay of 212 days in filing the above appeal and the petitioner is a resident of Perambalur District. Hence, he vehemently opposed for allowing this petition.

4. Heard both sides.

5. Satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.
