ORDER

The Petitioner/wife has filed this Transfer Civil Miscellaneous Petition seeking to withdraw the H.MO.P.No.281 of 2023 pending on the file of the Family Court, Tiruvallur and transfer the same to the file of the Family Court, Chennai.

2. The respondent-husband had filed H.MO.P.No.281 of 2023 on the file of the Family Court, Thiruvallur District for divorce.

3. The petitioner-wife seeks transfer on the following grounds: (i) The petitioner is a resident of Chennai where she is living with her child in her parents' home.

(ii) She is depending on her parents even to meet her dayto-day expenses. (iii) She is unemployed and has no independent source of income to meet the travel and other expenses. (iv) She has to travel nearly 50 kms up and down from Chennai to Thiruvallur for every hearing along with her child which is very difficult for her.

(v) The respondent- husband is not paying any maintenance to her.

4. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the materials available on record. 2/4

Taking into consideration the facts and circumstances of the case and looking into the grievances expressed by the petitioner, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.281 of 2023 pending on the file of the Family Court, Thiruvallur shall stand withdrawn and transferred to the file of the Family Court, Chennai.
