ThePetitioner shall appear before this court on 10.00 am., and 5.00 p.m., daily without fail, until further orders and he shall not leave Vellore without prior permission of this Court in the bail order dated 09.01.2026 in Crl.M.P.No.15 of 2026 on the file of the Special judge for Exclusive Tail of cases Under Pocso Act Vellore. ORDER
This petition has been filed seeking modification of the conditions imposed on the petitioner in Crl.M.P.No.15 of 2026, dated 09.01.2026 on the file of the learned Special judge for Exclusive Tail of cases Under Pocso Act Vellore. The conditions imposed are as follows : " i.
On executing a Bond for Rs.25,000/- with two sureties for a like sum and one of the sureties must be either blood related or closely related and both of them must be solvent to execute bond, and ii.
The Petitioner shall appear before this court on 10.00 a.m., and 5.00 p.m., daily without fail, until further orders and he shall not leave Vellore without prior permission of this Court".

The learned counsel for the petitioner submitted that the petitioner is unable to produce two sureties, particularly a blood relative or close relative and both of them must be solvent to execute bond, as required by the above said order. It is further submitted that since the petitioner is in custody, he is not in a position to secure such sureties. Hence, the present petition has been filed to modify the said condition.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent and also perused
the materials available on record, including the order passed by the learned Special Judge for Exclusive Trial of Cases under POCSO Act, Vellore. 4.
Considering the fact that the petitioner is in custody, and is unable to produce a blood relative or close relative as surety, this Court is of the view that insisting upon such a condition is not necessary. Accordingly, the order dated 09.01.2026 passed in Crl.M.P.No.15 of 2026 is modified the following condition alone :
" i.
The petitioner shall execute a Bond for Rs.25,000/- (Rupees Twenty-Five Thousand only) with two sureties for a like sum; "

The other conditions imposed in the order dated 09.01.2026 passed in Crl.MP.No.15 of 2026 shall remain unaltered. 6.
Accordingly, the criminal original petition is ordered, and the condition is modified.
