Crl.M.P.No.12838 of 2016 in Crl.R.C.No.1569 of 2016 C.T.SELVAM, J Petitioner was detained pursuant to orders of first respondent dated 27.11.2016. The allegation against petitioner is that having executed a bond for maintaining good behaviour for a period of six months, petitioner has indulged in wrong doings. Against the orders of detention passed by first respondent dated 27.11.2016, the present revision has been filed.
2. Crl.M.P.No.12838 of 2016 has been filed seeking suspension of sentence imposed on petitioner.
3. Learned counsel for petitioner would submit that petitioner is confined at Central Prison, Trichy.
4. Heard learned Government Advocate [Crl.side] on the submissions made by learned counsel for petitioner.
5. Considering the facts and circumstances of the case and that there are arguable points involved in the revision as contended by learned counsel
C.T.SELVAM, J gm for petitioner, and further the revision is not likely to be taken up for final hearing in the near future, this Court is of the considered view that the petitioner herein is entitled to the relief of grant of suspension of sentence. Accordingly, the substantive sentence of imprisonment alone is suspended and petitioner is directed to be enlarged on bail on condition that the petitioner shall execute a bond in a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the respondent and on further condition that petitioner shall appear before the respondent on the first working day of every month at 10.30 a.m. pending revision.
