PRAYER : Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other appropriate Writ, order or direction by directing the 1st respondent to consider the Representation of the Petitioners dated 19.09.2022 and to take action in accordance with the provisions of the Tamil Nadu Societies Registration Act, 1975 within a time to be fixed by this Hon'ble Court.

This Writ Petition has been filed for a direction to the 1st respondent to consider the representation of the petitioners dated 19.09.2022 and take action in accordance with the provisions of the Tamil Nadu Societies Registration Act, 1975 within the time frame that may be stipulated by this Court.

3. Since, no adverse order is being passed against the respondents 2 & 3, notice to respondents 2 & 3 is dispensed with.
4. It is the case of the petitioners that the Annual General Meeting of the 2nd respondent council proposed certain amendments to the bye-laws with an intent to benefit few persons. The petitioners along with some members had sent a representation to the 1st respondent questioning the amendments sought to be made in the bye-laws under the guise of approval of General body said to have been obtained on 18.09.2022. Since there was no response from the 1st respondent, the petitioners filed a Writ Petition in W.P.No.26769 of 2022 for a direction to the 1st respondent to consider the petitioners' representation dated 19.09.2022 and that Writ Petition was disposed recording the submission of the 1st respondent that the petitioners' representation dated 19.09.2022 has already been considered. However, the petitioner alleges that till date, no order has been passed by the 1st respondent. Hence this Writ Petition.
5. Learned counsel for the petitioner submits that it would suffice if this Court issues a direction to the 1st Respondent to consider the petitioner's representation dated 19.09.2022 and pass appropriate orders on merits within Page No:3/6
the time that may be stipulated by this Court.
6. On the above contention, this Court heard the learned Special Government pleader appearing for the 1st respondent.
7. In view of the limited relief sought for by the petitioner, this Court without going into the merits of the issue, directs the 1st respondent to enquiry on the representation dated 19.09.2022 made by the petitioner and pass appropriate orders in accordance with law after affording an opportunity of personal hearing to the petitioner as well as to the aggrieved parties if any within a period of six weeks from the date of receipt of a copy of this order.
8. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
