A.NO.1918 OF 2023 IN C.S.NO.65 OF 2022 N.SATHISH KUMAR, J.

This application has been filed to implead the Mortgagee Bank as one of the defendants in the above Suit on the ground that during the pendency of the Suit, the third defendant has mortgaged the property to the proposed party for a sum of Rs.6,00,00,000/- (Rupees Six Crores Only) and hence, to have an effective adjudication, it is necessary to implead the above party.

2.Considering the nature of the dispute and the defendants have no objection for allowing this application and also the fact that the applicant / plaintiff being the dominus litis, seeks the relief against the proposed party, this application is ordered.

3.Registry is directed to permit the applicant / plaintiff to carry out necessary amendment and file amended plaint copy and after amendment, issue notice to the newly added party returnable by 15.12.2023. Private notice is also permitted.
