ORDER
WMP. No.6801 of 2026 is ordered subject to the payment of separate court fee.
2.This writ petition has been filed to direct respondents 1 to 3 to restore the patta in favour of the petitioners for the property, morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court. 3.The petitioners seek for restoration of patta, morefully described in the prayer to this writ petition, which is now standing in the name of respondents 4 to 6. The petitioners had filed an appeal dated 07.10.2024 before the second respondent seeking for cancellation of patta issued in favour of respondents 4 to
6. Since the said appeal has not been disposed of till date, the petitioners have filed this writ petition.
4.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 3. Since no adverse order is being passed against respondents 1 to 3, notice to respondents 1 to 3 is dispensed with by this Court. 5.No prejudice would be caused to the official respondents if a direction is issued to the second respondent to dispose of the petitioners' appeal dated
07.10.2024, if the same has not already been disposed of, on merits and in accordance with law, after hearing the objections of respondents 4 to 6 and any other third party whom the second respondent deems it fit to enquire, within a time frame to be fixed by this Court.
6.This Court is not expressing any opinion on the merits of the petitioners' appeal.
7.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioners' appeal dated 07.10.2024 seeking for cancellation of patta, issued in favour of respondents 4 to 6 for the property, morefully described in the prayer to this writ petition, after hearing the objections of respondents 4 to 6 and also any other third party whom the second respondent deems it fit to enquire, if the said appeal has not already been disposed of, within a period of 12 weeks from the date of receipt of a copy of this order.
