Respondents Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the 3rd respondent herein to grant one month leave to my brother Dhanakanthan, S/o.Dhakshnamoorthy, convict prisoner (CT No.15248), aged about 41 years, confined in Central Prison, Cuddalore, for attending ritual obligation of "Karuma Kariyam" for his deceased mother and also make partition of his family property by considering the petitioner's representation dated 03.03.2021.

Dhanakanthan, is a convict prisoner (CT.No.15248) and is undergoing imprisonment in Central Prison, Cuddalore. It is the further case of the petitioner that Dhanakanthan's mother died and for settling the family properties, a leave application dated 03.03.2021 was given to the Superintendent, Central Prison, Cuddalore, which has not been considered till date. Hence, the present writ petition.
2. On instructions, the learned Government Advocate (Crl. Side) submitted that Dhanakanthan has been granted three days leave with escort by the Superintendent, Central Prison, Cuddalore, by order dated 13.03.2021. But, Dhanakanthan has not availed of the same.
3. In view of the above, this writ petition is closed with liberty to Dhanakanthan to avail of the leave for three days with minimum escort that has been granted by the Superintendent, Central Prison, Cuddalore, vide order dated 13.03.2021. No costs.
