PRAYER : Writ Petitions filed Under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents more particularly the 3rd and 4th respondents to release the state list of identified remote/difficult/rural areas at the earliest and to release the state rank list that the meritorious and top ranked Post Graduate candidate from Tamil Nadu will not be compelled to do their Post Graduate outside Tamil Nadu and to conduct the State counseling in between the dates of the All India 1st and 2nd round giving sufficient time to the eligible candidates to appear. The prayer sought for in the writ petition is for a direction to the respondents, in particular, third and fourth respondents to release the State list of identified remote, difficult and rural areas at the earliest and to release the State Rank List and to conduct the State counselling in between the dates of the All India first and second round of counselling.
2. Heard the learned counsel appearing on both sides.
3. After notice was being accepted by the learned counsel for the respondents 2 and 3, on 06.03.2019 G.O.(Ms).No.86, Health and Family Welfare (MCA1) Department, dated 06.03.2019 was published for awarding of incentive marks to the in-service candidates for their service rendered in the remote/difficult/rural areas for admission to Post Graduate Medical Courses. Thereafter, G.O.(Ms).No.443, Health and Family Welfare (MCA1) Department, dated 08.03.2019 was published. On the same date, G.O.(Ms).No.444 Health and Family Welfare (MCA1) Department, dated 08.03.2019 was also published. Pursuant to the above notifications, the commencement of online application was started on 11.03.2019 at 10.00 A.M. and the last date for online submission of application is on 20.03.2019 upto 5.00 P.M. The last date for receipt of filled in online application is on 22.03.2019 upto 5.00 P.M. Though, originally the date of publication of the rank list was fixed as 03.04.2019, it is now changed to 31.03.2019. The All India first round of counselling
commences on 12.03.2019 and spread over till 24.03.2019 and the last date of joining is 03.04.2019. Now, the declaration of rank list changed into 31.03.2019 and the first round of State counselling commences from 01.04.2019 to 05.04.2019. The second round of counselling for All India quota commences from 06.04.2019 to 12.04.2019 and the last date of joining is 22.04.2019. Therefore, the prayer of the petitioner is satisfied, in view of the above dates released by the second and third respondents.
4. Recording the same, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
