CRP NO. 754 of 2025
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 26-02-2025
CORAM
THE HONOURABLE MS. JUSTICE P.T. ASHA CRP NO. 754 of 2025 C. Madan .. Petitioner Vs D. Kayathiri .. Respondent PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, praying to direct the learned Principal District and Sessions Judge, Chengalpet to dispose the GWOP.No.385 of 2023 within a period of three months so as to enable the petitioner to admit his son Master Anoop in a reputed educational institute at Canada.
For Petitioner(s): S. Nagarajan
ORDER
Seeking early disposal of the guardian OP filed by him in GWOP.No.385 of 2023 on the file of the Principal District and Sessions Court, Chengleput, the petitioner is before this Court.
2. A perusal of the notes of the proceedings would show that the parties were before the mediation from 05.02.2024 to 16.12.2024. Since mediation failed, the
matter has been adjourned for filing counter on 26.02.2025. At this juncture, the petitioner seeks an early disposal of the said original petition stating that one Ashima Bebarta with whom he has contracted a 2nd marriage, as there was no chance of re-union with the respondent, is in Canada and he wants to take his son Master Anoop to Canada to enable him to get a good education and since the academic year is coming to end, an early disposal of the GWOP is required.
3. Without giving time to the respondent to file counter, this court cannot direct early disposal of the GWOP. As stated supra, the matter has been adjourned for the first time for counter to 10.02.2025. Therefore, the request for early hearing cannot be granted at this juncture. Consequently, the Civil Revision Petition is dismissed. No costs. It is needless to state that the request can be renewed if the GWOP is being dragged on unnecessarily without valid reasons. 26-02-2025 msr Index:yes/no internet:yes/no To The Principal District and Sessions Judge, Chengalpet
