ORDER
There is no representation for the petitioner. On the earlier hearings also there was no representation for the petitioner. Hence, the name of the petitioner is printed in the cause list today.
2. Mr.S.Rajesh, learned Government Advocate, appearing for the respondents is present.
3. The learned Government Advocate Mr.S.Rajesh, would submit that the petitioner joined in service by producing forged School Certificate as well as Experience Certificate. Based on the complaint received from the Chief Minister's Special Cell, disciplinary proceedings were initiated against the petitioner under Section 17(b) of the Tamil Nadu Government Servants (Disciplinary and Appeal) Rules. As per the orders passed in the Departmental Proceedings dated 30.09.2009, order of censure and his pay was brought down to the basic scale and the extra benefits were withdrawn from him and ordered to be recovered. 2/6

On perusal of the impugned order, as the petitioner has by submitting forged School Certificate and Experience Certificate and joined in the service and departmental proceedings were initiated and charge under Section 17(b) of the Tamil Nadu Government Servants (Disciplinary and Appeal) Rules, framed and an order (dated 30.09.2009) of censure was passed and his pay scale was brought down to the basic scale and the extra benefits extended to him for the period from 01.07.2004 to 30.11.2010, an amount of Rs.26,732/- in 12 installments, i.e., for 1st installment in October 2012, an amount of Rs.2532/- and Rs.2,200/- per installment for the period from November 2012 to September 2013 was ordered to be recovered.
5. The learned Government Advocate would submit that as per the impugned order, the said amounts have been already recovered and nothing survives for further adjudication in this writ petition.
6. Recording the above said submissions, this writ petition stands dismissed as infructuous. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs. 09.07.2024 Index : Yes / No 3/6
