a judgment and decree:- a) declaring that the plaintiff is the owner of the suit property viz., land bearing plot No.2202 situated at Door No.56 A-F Block, 11th Main Road, A.A.Nagar, Chennai 600 040 measuring an extent of 5000 S.Ft. or thereabouts (2 Grounds and 200 Sq. ft.) comprised in R.S.No.162/1 part of Naduvakkarai Village, Egmore Nungambakkam Taluk, Chennai revenue District with 25 meters deep pile foundations and for consequential permanent injunction restraining the 1st and 2nd defendants, their men, agents or any person claiming under them from dealing, including creating any encumbrance, with the suit property in any manner whatsoever;

b) and for the cost of the suit.

J U D G M E N T

The parties have entered into a compromise. A Joint Memorandum of Compromise dated 05.08.2019 signed by the parties as well as the Counsels, has been filed incorporating the terms of the compromise entered into between the parties. As per Clause (I) of the said compromise, the plaintiff has paid a sum of Rs.1,00,00,000/- by way of two 2/4

Demand Drafts, as set out in Clause (I) in favour of defendants 1 and 2 for Rs.50,00,000/- each. The Demand Drafts have been handed over to defendants 1 and 2. Hence the terms of the Joint Memorandum of Compromise are recorded and the suit is decreed in terms of the Joint Memorandum of Compromise.

2. The Joint Memorandum of Compromise shall form part of the decree. Parties to bear their own costs. Consequently, the connected original applications are closed.
