This petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.2519 of 2023 dated 07.02.2023 in para 6(a) as follows :- "6.(a) the petitioner is directed to deposit a sum of Rs.50,000/- (Rupees fifty thousand only) to the credit of Crime No.38 of 2023 before the concerned Magistrate within a period of fifteen days and the defacto complainant is permitted to withdraw the said deposit amount of Rs.50,000/- on proper identification and acknowledgment."

2. The learned counsel for the petitioner submitted that as he is a poor agriculturist and a daily coolie worker, he is not able to mobilise the amount of Rs.50,000/-. So, he finds difficult to comply the condition imposed by this court. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.10,000/- (Rupees ten thousand only) to the credit of Crime No.38 of 2023 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order and the defacto complainant is permitted to withdraw the said deposit amount on production of proper identification and acknowledgment.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 2519 of 2023 vide order dated 07.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
