PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Habeas Corpus directing the Respondents to produce the body of V.Balaji, aged 24 years, brother of the Petitioner before this Court and set him at liberty by handing over him to the Petitioner. For Petitioner :

Mr.R.Ravichandran, APP Order of the Court was made by M.VENUGOPAL,J Heard the Learned Counsel for the Petitioner and the Learned Additional Public Prosecutor appearing for the First Respondent.

2. The First Respondent has produced the detenu V.Balaji, who is the brother of the Petitioner, aged 24 years.

3. The Learned Counsel for the Petitioner has made an endorsement in the above petition, which runs as under : "The detenu is produced before this Court. Nothing survives. The Petitioner is not pressing. Hence, the petition may be withdrawn."

4. This Court has examined the detenu - V.Balaji, who, on enquiry, has stated that his date of birth is 12.10.1993, that he is aged 24 years and studied upto B.E. (Civil) in Veltech College, Avadi and that he got married to the Second Respondent on 13.2.2018 at Amman Temple in Kanchipuram. He further states that he got acquainted with the Second Respondent when she was doing her Bio-Medical (B.E.) Course in Veltech College, Avadi. Later, she had discontinued her Bio-Medical (B.E.) Course at Veltech College and joined in the Jerusalem College, Pallikaranai in the same Bio-Medical (B.E.) Course. According to the detenu, the Second Respondent is in her house and he is residing with his father at No.40/10, Ponniyammam Koil Street, Rangarajapuram, Little Mount, Saidapet, Chennai-15.

In view of the fact that the detenu is produced before this Court and also taking note of the prime fact that the Learned Counsel for the Petitioner has made an endorsement in the above Petition that the detenu is produced today and hence, the above petition is not pressed, recording the aforesaid fact, this Court dismisses the above petition as nothing survives for any further adjudication.
