in HCP No.1860 of 2022 M.SUNDAR, J., and M.NIRMAL KUMAR, J., (Order of the Court was made by M.SUNDAR,J.,) Captioned 'Criminal Miscellaneous Petition' [hereinafter 'Crl MP' for the sake of convenience and clarity] has been filed with a prayer to fix an early date.

2. We heard out the captioned Crl MP. Primary ground on which the captioned Crl MP has been filed is that the detenu is unwell.

3. Mr.R.Muniyapparaj, learned Additional Public Prosecutor who accepts notice on behalf of respondents has placed before us a medical report from Central Prison Hospital, Puzhal, Chennai and it comes to light from the medical report that vitals of the detenu are stable and his general condition is good. To be noted, the detenu was given treatment in Stanley Government Hospital.

4. Faced with the above situation, Mr.J.William Shakesphere, learned counsel sought leave of this Court to withdraw the captioned Crl MP. Learned counsel has made an endorsement in the case file and a scanned reproduction of the same is as follows:

5. Learned counsel made a plea that the rights of the petitioner may please be preserved to come up with same / similar petition if there is change of circumstances.
