ORDER

Seeking a direction to the respondents to register a case on the complaint of the petitioner dated 19.10.2016, the petitioner has come up with this petition.

2. It is the case of the petitioner that he has lodged a complaint against one N.Kannan and others alleging that they jointly misappropriated a sum of Rs.50,00,000/- belonging to Kanniga Parameswari Temple and Mutt. After coming to know about the same, the said Kannan and others filed a suit in O.S.No.540 of 2013 before the learned District Munsif, Udumalpet, for declaration that the properties of the said temple and mutt are belonging to their Arya Vasiya Yuva Jana Sangam and the suit is pending. Since no action was taken on the said complaint, the petitioner is before this Court with the present petition. https://hcservices.ecourts.gov.in/hcservices/

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondents.

4. Considering the facts and circumstances of the case, this Court directs the second respondent to hold appropriate enquiry, on the petitioner's complaint dated 19.10.2016 and if the allegations made therein disclose commission of cognizable offence, register a case, investigate the same and file a final report or close the same as the case may be, in accordance with law, as expeditiously as possible.

5. This Criminal Original Petition is disposed of accordingly.
