ORDER : The Court Made the following order :- The petitioners are A2 and A3. Apprehending arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 353, 379, 430, 392 and 307 of IPC r/w Section 21
(1) of Mines and Minerals Development Regulation Act in Crime No.147 of 2020 on the file of the respondent police, the petitioners seek anticipatory bail.
2. The case of the prosecution is that on routine checkup they intercepted a Tata 207 truck and found 1/4 unit of sand without valid permit. While intercepting the vehicle, the petitioners tried to run over the policemen on duty. Hence, the respondent police registered a case against the petitioners.
3. The learned counsel appearing for the petitioners submitted that the petitioners did not indulged in any offence. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Additional Public Prosecutor vehemently opposed this petition. He submitted that the petitioners tried to run over the policemen when they tried to intercept the vehicle. He further submitted that each of the petitioner has previous case of similar nature pending against them. He would further submit that there are every chances of the petitioners getting absconded and thereby, derailing the progress of investigation. https://hcservices.ecourts.gov.in/hcservices/
5. Taking into consideration the gravity of the offence and the petitioners were involved in previous case of similar nature and they have bad antecedents, this Court is not inclined to grant anticipatory bail to the petitioners.
6. This Criminal Original Petition stands dismissed accordingly.
