Heard the learned counsel appearing for the petitioner. Since this Court is not inclined to pass any adverse order as against the respondents, notice to the respondents is dispensed with. 2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent to issue a No Due Certificate (NDC) to the petitioner's property in S.F.Nos.72/1 and 79/3, Vadavalli Village, Coimbatore District and consequently directing the fourth respondent to remove all entries made in the Encumbrance Certificate by virtue of the order passed in EP No.73 of 2008 on the file of the Hon'ble District Judge, Coimbatore vide order dated 15.09.2009. 3.The learned counsel appearing for the petitioner submitted 2/6
that the petitioner is the owner of the subject property and the subject property was originally provided as a security/ equitable mortgage to the first respondent to secure financial facilities extended to M/s.Karthikeya's Company and due to the alleged default by the company, the first respondent initiated arbitration proceedings in A.O.P.No.1 of 2008 and subsequently an execution petition in E.P.No.73 of 2008 was filed before the learned District Judge, Coimbatore for recovery of Rs.1,18,40,681/- and on 15.09.2009, the learned District Judge, Coimbatore ordered for attachment of the petitioner's property and following the attachment, the property was brought to sale on 14.11.2011, however, the sale did not take place. 4.The learned counsel appearing for the petitioner further submitted that in late 2014, M/s.
Karthikeya's Company entered into settlement with the first respondent and on 17.12.2014, final payment was made via RTGS and the first respondent also acknowledged the same. In the year 2015, the petitioner submitted representation to the first respondent requesting No Due Certificate (NDC) and the formal cancellation of the charge creation to clear the title and since there was no response again made representation dated 05.03.
and return of original title deeds, however, there is no response. Hence, this Court may without going into the merits of the case, issue direction to the respondents to consider the petitioner's representation dated 05.03.2026 and to pass appropriate orders, within a reasonable time frame.
5.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, direct the respondents to consider the petitioner's representation dated 05.03.2026, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. 6.The writ petition is disposed of.
