This civil miscellaneous petition has been filed by the petitioner seeking to condone the delay of 315 days in filing the above appeal.

2. Though notice has been served on the respondent and his name has been printed in the cause list, he has not appeared before this Court either in person or through an Advocate.

3. Having regard to the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned and this petition is accordingly ordered.
