M/S Paranthaman Textiles Ltd v. Balasundara Mudaliar (Deceased)

C.M.P.No.5926 of 2024 in S.A.No.249 of 2012 C.M.P.No.5926 of 2024 in S.A.No.249 of 2012 K.RAJASEKAR , J., This Civil Miscellaneous Petition has been filed by the proposed parties seeking to implead them as one of the appellants in the above Second Appeal on the ground that, as per the compromise recorded in C.P.No.1 of 2000, 5/6 share of the suit property has been vested in favour of the proposed parties and thereby, they are having interest in the suit property. It is also reported that one M/s.Sri Laxmi Saraswathi Textiles Ltd., is the original owner and the suit is filed against one M/s.Paranthaman Textiles Ltd., which is not the title holder.

2. Heard the learned counsel for the petitioners and perused the records.

3. Considering the reasons stated in the affidavit filed in support of this petition and the fact that the proposed parties are having interest in the suit property at their interest was taken place even in the year 2003, this Court is inclined to implead them as the parties to the proceedings. Accordingly, this Civil Miscellaneous Petition is allowed.
