Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the 2nd respondent to consider the petitioner's representation dated 19.2.2021 and to remove the stair-case constructed on the Western side of the subject building situated at S.F.No.212/19. ORDER
The grievance of the petitioner is that his neighbouring plot owner, viz., the fifth respondent is constructing a house adjacent to the petitioner's property, by engaging an Engineer, the sixth respondent without any planning permission and without following any rules and regulations and therefore, he made a https://hcservices.ecourts.gov.in/hcservices/
representation to the second respondent on 19.2.2021, however, the same has not been considered so far and therefore, this petition is filed for a mandamus seeking a direction to the second respondent to consider the petitioner's representation.
2. Mr.Elumalai, learned Additional Government Pleader takes notice for the first respondent and Mr.Annai Ezhil, learned Government Advocate takes notice for respondents 2 and 3.

Since the writ petition is only for a direction to consider the representation of the petitioner, this court is of the view that no notice is required to be issued to the private respondents and accordingly, while dispensing with notice to them, without going into the merits of the representation, disposes the writ petition with a direction to the second respondent to take a decision on the representation after providing an opportunity to respondents 5 and 6 and inform the petitioner as to the steps taken on his representation within a period of six weeks from the date of receipt of a copy of this order. No costs.
