CMP.No.8931/2021 and AS.SR.No.25432/2021 [Video Conferencing] S.S.SUNDAR, J., Though the Counter Affidavit is filed in this case disputing the averments made in respect of the petition to condone the delay, this Court is convinced with the reasons stated in the affidavit. Having regard to the facts narrated in the affidavit, this Court finds that delay is properly and satisfactorily explained. In the result, this Civil Miscellaneous Petition is ordered. Registry is directed to number the appeal if the papers are otherwise in order.

2.Post this Appeal Suit for final hearing on 20.12.2021 as the parties have now indicated that there is a likelihood of a settlement.
