O R D E R
This Writ Petition has been filed seeking for issuance of a Writ of Mandamus to direct the 1st respondent herein to consider and dispose of the petitioner's representation dated 06.12.2021 within a stipulated period that may be fixed by this Court.
2. The learned Special Government Pleader takes notice for the official respondents. In view of the limited relief sought for in this petition and on the consent of the learned counsel appearing on either side, this petition is taken up for final disposal.
3. Since no adverse orders are being passed as against the private respondents, notice to the private respondents is dispensed with.
4. The case of the petitioner is that the petitioner is a partner of S.B.K. Housing Scheme along with her husband namely Selvakumar. The said partnership firm owned several lands in the districts of Chengalpattu. During the year 1983, the said firm had purchased an extent of land measuring about 5.08 cents in Sriperumbudur Taluk, Vatampakkam Village in Survey Nos. 7/2B, 14/1, 7/2D, 3/2D, 3/2E, 3/2L, 3/2K, 3/2M and the said lands were duly provided with Patta in the name of the firm. However, one part of the property was settled in favour of one Roopchandar, s/o. Krishnamoorthy and registered as Document No.5944/1995, on the file of SRO, Sriprembudur. The said Krishnamoorthy is the manager of the said firm, he executed that settlement deed in favour of his son. Aggrieved with the same, the petitioner made a complaint to the 2nd respondent on 06.12.2021, under Section 68
(2) of the Registration Act. However, till date no orders have been passed. Hence, this Writ petition is filed with the aforesaid prayer.
5. The learned counsel for the petitioner submitted that it would suffice if this Court issue direction to the 2nd respondent to consider the petitioner's representation dated 06.12.2021, and pass orders within a reasonable time that may be fixed by this Court.
6. The learned Special Government Pleader appearing on behalf of the official respondents submitted that the petitioner's representation dated 06.12.2021 will be considered by the respondents within a reasonable time that may be fixed by this Court.
7. This Court, without going into the merits of the case, directed the 2nd respondent to consider the petitioner's representation dated 06.12.2021, pass orders on merits and in accordance with law, after affording an opportunity of hearing the 3rd and 4th respondents and aggrieved parties if any, within a period of twelve weeks from the date of receipt of a copy of this order.
8. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
