Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st respondent to consider and pass orders on the Review petition dated 17.01.2020 (along with the petition seeking condensation of delay dated 17.01.2020) preferred by the petitioner against the Order of Removal from service issued by the second respondent in D.O.No.246 of 2019 (C.No.H1(2) 06244/74/2019) dated 14.03.2019 within a period limited time frame.

O R D E R

This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to consider the review petition filed by the petitioner on 17.01.2020 and to pass orders, within the time fixed by this Court. 2.

It is seen from records that the petitioner was working as a Head Constable and a charge memo came be issued against him by virtue of a criminal case registered against the petitioner for an offence under 7 of Section Prevention of Corruption Act, 1988. The petitioner was subsequently convicted in the criminal https://hcservices.ecourts.gov.in/hcservices/

case and the same resulted in an order passed by the 2nd respondent, removing the petitioner from service on 14.03.2019. 3.

The petitioner aggrieved by the same, has filed a review petition before the 1st respondent on 17.01.2020.

Simultaneously, the petitioner has also filed a Criminal Appeal before this Court and the same is pending in CA No.86 of 2019. The petitioner has approached this Court seeking for direction to the 1st respondent to dispose of the review petition. 4.

Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents. 5.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the 1st respondent to consider the review petition filed by the petitioner on 17.01.2020 and pass appropriate orders, within a period of three months from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the 1st respondent along copy of the review petition dated 17.01.2020 and also a copy of this order.

This writ petition is disposed of with the above directions.
