... Defendants Plaint filed and Suit numbered under Order VII Rule 1 of CPC R/w. Order IV Rule 1 of Original Side Rules, praying for judgment and decree as follows:

a. for grant of mandatory injunction directing the defendants 1 and 2 or their duly appointed power of attorney agent to be present along with the plaintiff or his duly appointed power of attorney agent in the 3rd defendant bank for opening of the locker in the 3rd defendant bank bearing No.668 standing in the name of the deceased mother of the plaintiff, Smt.Vijaya Ramachandran and consequently direct the 3rd defendant to open the said locker, if required by breaking open the same and hand over the article and valuables inside the said locker to the plaintiff. (b) for a mandatory injunction directing the defendants 1 and 2 to given an inventory of the items removed by them from the said locker in the 3rd defendant bank ;

(c) directing the defendants 1 and 2 to pay the cost of the suit. For Plaintiff : Mr.V.G.Suresh Kumar For Defendants : Mr.Anirudh Krishnan for D1 and D2 Mr.A.V.Radhakrishnan for D3

JUDGMENT

Mr.V.G.Suresh Kumar, learned counsel for the plaintiff, Mr.Anirudh Krishnan, learned counsel for the defendants 1 and 2 and Mr.A.V. Radhakrishnan, learned counsel for the 3rd defendant submitted that the dispute between the parties has been amicably settled and they have filed a joint memo of settlement dated 04.01.2019, signed by the power agents of the parties as well as the counsel, to that effect. The power agents of the plaintiff and the defendants along with their counsels are present.

2. In view of the above, the civil suit is decreed in terms of the joint memo of compromise and the joint memo of compromise shall form part of the order. Registry is directed to refund necessary Court fee to the plaintiff as per Rules. No costs.
