ORDER

The writ petition has been filed to call for the records in respect of the order / award in I.D.No.235 of 2007 by the first respondent herein dated 16.08.2012 and quash the same.

2. When the matter is taken up for hearing, it is reported that after negotiation between the parties and as suggested by this Court, an amicable settlement has been arrived at between the parties. Accordingly, Mr.Ashik S. Delhiwala, son of the Proprietor appeared before this Court and gave an oral undertaking that he is willing to pay the compensation amount of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) to the second respondent by way of ten equal monthly installments starting from April 2023. He further submitted that he is a monthly salaried person and drawing Rs.45,000/- p.m. out of which he is ready to pay Rs.15,000/- per month in ten equal installments.

3. The learned counsel appearing for the second respondent agreed for the above said amount. He further submitted that they have filed W.P.No.32477 of 2014 challenging the award passed by the labour Court and the same is pending before this Court.

4. The petitioner is directed to pay a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) in 10 equal monthly installments to the second respondent i.e., Rs.15,000/- (Rupees Fifteen Thousand Only) on or before 10th of every English Calender month starting from April 2023, without any default.

5. Recording the above submission, this writ petition is closed. No costs.
