Though the earlier anticipatory bail petition of the petitioner was dismissed by my learned predecessor, Hon'ble Justice A.D.Jagadish Chandira, this petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P.No.31787 of 2024 on 04.03.2025.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 191(2), 191(3), 329(4), 296(b), 118(1), 351(3) of BNS 2023 and Section 4 of Tamil Nadu Prohibition of Women Harassment Act 2002 and Section 3 of Tamil Nadu Property (Prevention of Damage and Loss) Act 1992 in Crime No.173 of 2024, seeks anticipatory bail.

The case of the prosecution is that the defacto complainant's daughter is studying 12th standard; that on 01.10.2024, the petitioner and other accused trespassed into the defacto complainant's house and abused her with filthy language and attacked the defacto complainant and her daughter. The accused persons damaged the household articles worth about Rs.80,000/-.

The earlier anticipatory bail application was dismissed by this Court in Crl.O.P.No.31720 of 2024, dated 02.01.2024, by making the following observations:
"4.Considering the facts and circumstances of the case and the fact that the petitioner has committed very heinous offence as against the minor victim girl and hence, this Court is not inclined to grant bail to the petitioner"

This Court finds no change in circumstances and is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
