... Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.F.Terry Chella Raja, learned counsel for appellants and Mr.K.Poomalai, learned counsel for the respondent 2 is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: 1/5
TERMS OF SETTLEMENT The Commissioner of Labour-I has awarded a sum of Rs.8,52,160/- with interest at 12% per annum. There is no details with regard to apportionment. Aggrieved by the award of the Tribunal, the appellants had preferred the present appeal.
2. After due deliberation and consultation, both the parties have agreed for the award amount of Rs.8,52,160/- (Rupees Eight Lakhs Fifty Two thousand One Hundred and sixty only) with interest as compensation.
3. The 2nd respondent is directed to deposit the above said accepted award amount of Rs.8,52,160/- (Rupees Eight Lakhs Fifty Two thousand One Hundred and sixty only) with interest, after deducting the amount already deposited if any, within a period of eight weeks from the date of receipt of a copy of this award. Apportionment of the award amount is as follows, (i) 1st appellant - Rs.5,02,160/- (ii) 2nd appellant - Rs.2,00,000/- (iii) 3rd appellant - Rs.75,000/- (iv) 4th appellant - Rs.75,000/-
4. On such deposit, the claimants are permitted to withdraw the modified amount without filing any formal petition. Award is passed accordingly. 2/5
5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. The connected miscellaneous petition is closed, if any.
