Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 3rd respondent to stall the sale in respect of the property at Sri Chakra Sangeetha Apartments, 2nd Floor, Door No.42/4, 47th Street, 9th Avenue, Ashok Nagar, Chennai-600 083.
For Petitioner :
Mr.M.Saravana Kumar For Respondents:
Mr.P.P.Purushothaman Government Advocate for R1 to R3 Mr.E.Balamurugan Special Government Pleader for R4 & R5
O R D E R
Mr.P.P.Purushothaman, learned Government Advocate takes notice for the respondents 1 to 3. Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondents 4 & 5.
2. The petitioner seeks for a mandamus directing the third respondent to stall the sale in respect of the property at Sri Chakra Sangeetha Apartments, 2nd Floor, Door No.42/4, 47th Street, 9th Avenue, Ashok Nagar, Chennai-600 083.
3. It appears that the petitioner on one hand and the respondents 6 & 7 on the other hand, have some private dispute in respect of the property referred to in this writ petition. It is seen that the petitioner has already given a police complaint against those private respondents as well.
4. If that be the case, it is for the petitioner to work out her remedy against the private respondents in the manner known to law and not by filing the present writ petition, that too, seeking a direction to the third respondent as sought for in this writ petition. Hence, I find no merits to entertain this writ petition. Accordingly, without expressing any view on the merits of the claim made by the petitioner, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
