Respondents Prayer:- Contempt Petition filed under Section 11 of the Contempt of Courts Act, seeking to punish the respondents for having committed the gross contempt and wilful disobedience of the final orders passed by this Court in W.P.No.28730 of 2015 dated 11.09.2015.

O R D E R

Heard the submissions of the learned counsel appearing for the petitioner, Mrs.P.Kavitha, learned Government Advocate appearing for the respondents and also perused the counter affidavit filed by the first respondent.

2. In para 8 of the counter affidavit filed by the first respondent it is averred as follows:

"8.It is respectfully submitted that on 15.10.2015 the first respondent received one representation of the petitioner dated 14.09.2015 along with the Hon'ble Court order dated 11.09.2015 which was sent by Registered Post only on 14.10.2015. In obedience of the Hon'ble Court order and considering the representation of the petitioner with law and merits and the first respondent decided to modify the earlier order made to the petitioner and accordingly, the modification order was passed in proceedings No.2373/A1/2015 dated 25.11.2015 transferring the petitioner to the Government High School, Eraiyur which is located within a distance of 9 km from the petitioner's house (petitioner claiming place Karasanur is also 9 Km from his house). But even then not satisfying and obeying the proceedings of the 1st respondent, the petitioner had not joined at Eraiyur and till date he is continuing the Unearned Leave on Medical Certificate."

3. In the light of the said development, this Contempt Petition is closed, granting liberty to the petitioner to challenge the order dated 25.11.2015, if he is so advised and in accordance with law.
