ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.01.2026 for the offences punishable under Sections 296(b), 351(2), 332(b), 64(2)(m) of BNS, Section 4 of POCSO Act and Section 67(A) of IT Act in Crime No.01 of 2026 on the file of the respondent police, seeks bail. 2.

The allegation against the petitioner herein is that, the petitioner is a relative to the victim girl, who is aged about 17 years and they were in a prohibited relationship; that on the advice of the victim's family members, the victim girl withdrawn from that relationship; that the petitioner unable to bear the same started harassing the victim girl and also uploaded the photographs taken by them during their relationship in the social media platform along with defamatory and inappropriate comments; that while the victim's parents questioned the petitioner regarding the same, the petitioner threatened them of dire consequences and also threatened that he will attack the victim with acid. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any 2/4

offence as alleged by the prosecution; that the petitioner and the victim are close relatives and they were in consensual relationship; that only to harass the petitioner, a false complaint has been lodged against the petitioner and he is in judicial custody since 19.01.2026; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the petitioner herein is aged about 25 years and the victim girl is aged about 17 years; that the petitioner had got acquaintance with the victim girl and had on the victim girl; that the investigation of this case was completed and final report filed.

Considering the submissions made, facts and circumstances of the case, the gravity of offence, taking note of the harassment made by the petitioner herein by uploading the photographs of the victim with defamatory and inappropriate comments in social media and if the petitioner is enlarged on bail, he will indulge in similar offence, hence this Court is not inclined to grant bail to the petitioner.
