C.M.P. No.3946 of 2022 in S.A. No.268 of 2018 S.S.SUNDAR, J., This petition is filed to set aside the order passed in S.A. No.268 of 2018, restore the case on file and dispose the same on merits.

2. Heard Mr. C.Prakasam, learned counsel for the petitioner.

3. In the affidavit filed in support of the petition the petitioner has given some usual reasons. The petitioner has stated that he is now engaged a different counsel to represent him in the above second appeal. Though the reasons are not fully satisfactory, this Court is inclined to order the petition on condition that the petitioner shall pay a sum of Rs.2,000/- (Rupees Two Thousand Only) to the counsel for the respondent.

4. While dictating the order, counsel for the petitioner paid a sum of Rs.2,000/- to the counsel for the respondent and counsel for the respondent also acknowledges the receipt of a sum of Rs.2,000/- from the counsel for the petitioner.

5. Accordingly, the Civil Miscellaneous Petition is ordered and the second appeal in S.A. No.268 of 2018 is restored on file. 18.04.2022 Note: Registry is directed to list the above second appeal on 26.04.2022. bkn https://www.mhc.tn.gov.in/judis
