O R D E R
The Writ Petition filed for a direction, directing the 3rd respondent to grant permission to conduct public meeting on 25.02.2019, near V.C.M.Street, Thirupattur. 2.By consent, the Writ Petition is taken up for final disposal.
3.The learned counsel for the petitioner would submit that the petitioner has submitted an application for conducting a public meeting on 25.02.2019 from 06.00
pm to 10.00 pm at V.C.M.Street, Thiruppathur and the same was rejected by the 3rd respondent by the impugned order dated 16.02.2019. Hence, the petitioner has come before this Court by way of this Writ Petition.
4.The learned Public Prosecutor would submit that for the same venue and the same date, an another political party also sought for permission to conduct public meeting in the eve of 71st birthday of former Chief Minister of Tamil Nadu. Therefore, request of the petitioner was rejected by the impugned order dated 16.02.2019.
5.Heard Mr.S.P.Harikrishnan, learned counsel appearing for the petitioner and Mr.M.Mohamed Riyaz, learned Public Prosecutor.
6.It is seen from the impugned order that no such reason was mentioned by the 3rd respondent. However, the another political party sought for permission for the same venue and date to conduct public meeting on the eve of 71st birthday of former Chief Minister of Tamil Nadu. 7.Considering the above facts and circumstances, this Court directed the petitioner to submit a fresh representation by changing the venue and date for conducting public meeting to celebrate 71st birth anniversary of former Chief Minister of Tamil Nadu to the 3rd respondent within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the 3rd respondent is directed to consider the request made by the petitioner and pass orders on merits and in accordance with law, within a period of one week thereafter.
With the above direction, this Writ Petition is disposed of.
No costs.
Consequently, connected Miscellaneous Petition is closed.
