ORDER
This Petition has been filed seeking to punish the respondents for having violated the order passed in WP No.27910 of 2021 dated 26.09.2023.
2. This Court, by order dated 26.09.2023, while allowing the above said Writ Petition, directed the respondents to approve the appointment of Tmt.Shabana Begum as Secondary Grade Teacher in the petitioner school with effect from 01.12.2019 with all consequential monetary benefits within a period of eight weeks from the date of receipt of a copy of the order. Complaining willful disobedience of the said order, the present petition has been filed.
3.The learned counsel for the respondents has submitted that the order of the Court is communicated to the respondents on 12.10.2023. Thereafter, it is not complied with. He further submitted that a Writ Appeal has been filed against the order of the learned Single Judge and a Division Bench of this Court had dismissed the said Writ Appeal on 05.02.2024. Thereafter, the order of the Court has been complied with by issuing the proceedings dated 07.07.2025, to approve the appointment of the said teacher in the petitioner school and to release the grant. The learned counsel further submitted that consequent to the approval of the appointment order, all consequential monetary benefits including arrears are processed and within two weeks all the monetary benefits, for which
the petitioner is entitled will be paid to the petitioner. 4.Considering the facts and circumstances of the case and in view of the fact that approval of the appointment of Mrs.Shabana Begum as Secondary Grade Teacher in the petitioner school has been accorded and the process of settlement of all consequential monetary benefits is started, in our considered view, no further adjudication is required in this case. Accordingly, this Contempt Petition is closed. 5.It is made clear that as submitted by the learned counsel for the respondents, if monetary benefits including arrears are not paid to the petitioner within two weeks from today, Registry shall restore this Petition immediately and post before this Court for further hearing.
