This Writ Petition (Criminal) has been filed seeking a direction to respondents 1 and 2 to grant police protection to the petitioner, for survey and fencing of the petitioner's subject property by considering the petitioner's representation dated 28.01.2026.
Learned counsel appearing for the petitioner would submit that the petitioner is the owner of the properties in S.No.15/3A2, to an extent of 29.5 cents, 15/3G2 to an extent of 10.5 cents, 16/1A2, to an extent of 24.75 cents and 16/1J2 to an extent of 18 cents (totally 82.75 cents) situated at Soorapalli Revenue Village, Mettur Taluk, Salem District. He would submit that the petitioner, on 30.09.2025, had applied for conducting a survey and to transfer the patta in his name to the 3rd respondent/Tahsildar, Mettur Taluk, Salem District by paying necessary fees, but the same has not been surveyed and still pending. He would submit that since the 3rd respondent has not conducted the survey, the petitioner approached this Court by filing writ petition in WP.No.41960 of 2025, and this Court, by an order dated 10.11.2025, had 2/6
directed the Tahsildar to act upon the petitioner's application dated 30.09.2025 and conduct a survey in the subject property, based on the title document and patta, within a period of four weeks from the date of receipt of copy of the order. He would submit that at the same time, the 5th respondent had also filed WP.No.50459 of 2025 before this Court, seeking to consider her representation dated 21.12.2025, requesting to consider pending O.S.No.271 of 2022, on the file of Sub-Court, Mettur and not to conduct survey in the subject property; However, this Court by an order dated 06.01.
2026, had disposed of the writ petition by directing the 5th respondent herein to participate in the survey and demarcation of the boundaries conducted by the Tahsildar and to raise her objection before the Tahsildar, who is conducting the survey and demarcation of boundaries as per the earlier directions issued by this Court in WP No.41960 of 2025 and the respondents were also directed to complete the survey and demarcation of boundaries. He would further submit that the respondents four and five are preventing the survey from being conducted and hence, the petitioner had sent a representation on 28.01.2026 to the respondents one and two, seeking police protection. However, since the respondent Police have not taken any action, the present petition has been filed. 3.
Learned Government Advocate (Criminal Side) appearing for the respondents one to three submitted that though the petitioner claims that the 3/6
representation dated 28.01.2026, has been sent to the respondents, it has not been received by the respondents so far. He would further submit that in the event of the Tahsildar fixing a date for survey, pursuant to the order dated 10.11.2025 passed by this Court in WP.No.41960 of 2025, and order dated 06.01.2026 in WP.No.50459 of 2025 and seeks police protection, appropriate police protection will be provided by the respondent police. Heard the learned counsel on either side and perused the records. 5.
Since no orders adverse to the interest of the respondents four and five are passed, notice to them is dispensed with. If the 3rd respondent/Tahsildar, fixes a date for survey and requests for police protection, it shall be provided by the 2nd respondent.
