The petitioner, who apprehend arrest by the respondent police for the alleged offences punishable under Section 305(a) of BNS, in Crime No.12 of 2026 registered on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that he is ranked as A2. It is alleged that the petitioner joined hands with other accused, committed theft of various articles belongs to the defacto complainant worth about Rs.1,90,000/-. Hence a case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that A1 has already been arrested and a portion of the property was recovered, and therefore, no custodial interrogation of the petitioner is required. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that only three drilling machines have been recovered and the majority of the stolen articles are yet to be recovered. She further submitted that the petitioner has two previous cases pending against him. Hence, she opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police and perused the materials available on record.

6. Considering the nature of the allegations, the fact that only a portion of the stolen articles has been recovered and that the petitioner has two previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
