O R D E R

The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 7, 20(2) of COTPA Act read with Section 275, 123 of BNS in Crime No.52 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner in Crl.O.P.No.4335 of 2026 is A3 and the petitioner in Crl.O.P.No.4336 of 2026 is A4 and they colluded with A2 in this case and illegally transported 754 kgs of banned tobacco products .

3. The learned counsel appearing for the petitioners submitted that the petitioners were not present at the scene of occurrence and they have been falsely implicated in this case and hence he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the petitioners are main accused and they are present at the time of occurrence. Hence, he opposed to grant bail to the petitioner. 2/4

5. Considering the fact that huge quantity of banned tobacco products have been transported by the petitioners, this Court is not inclined to grant anticipatory bail to the petitioner.
