This application is filed to condone the delay of 29 days in filing the written statement by the 1st defendant.

2. In the affidavit filed in support of the application, the 1st defendant has stated that, in order to collect the relevant documents, which are the subject matter of pending suit in the District Munsif Court, Ambattur, delay of 29 days has crept in for filing the written statement and also the COVID 19 situation is cited as an additional cause for the delay.

3. Considering the reasons stated, the delay of 29 days in filing the written statement is condoned on payment of Rs.5,000/- (Rupees Five Thousand only) as costs payable to the plaintiff by 07.10.2021. On such payment, the written statement is taken on file.

4. Call the matter on 08.10.2021.
