O R D E R
This writ petition has been filed for a direction to the respondent Police to de-freeze the bank account of the petitioner maintained at the third respondent bank.
2.The learned Additional Public Prosecutor on instructions submitted that the bank account of the petitioner was freezed in the course of investigation in Crime No.910 of 2023 on 24.11.2023, whereas, it was intimated to the concerned jurisdictional Court on 06.02.2024.
3.In the light of the above submission, it is clear that the mandate under Section 102 of Cr.P.C. has not been complied with. Hence, the freezing of the bank account has become illegal and therefore, the same has to be defreezed immediately. If according to the respondent Police the freezing of the bank account is necessary during the course of investigation, the mandate under Section 102 of 2/4
Cr.P.C. should be followed strictly.
