This Criminal Original Petition is filed to quash the criminal investigation pending in FIR No.19 of 2023 on the file of the 1st respondent police for the offence under Sections 406, 420 & 468 IPC. 2.
Pending disposal of the quash petition, the petitioner / accused and the defacto complainant who are the sister and brother have settled their dispute in the mediation conducted by the mediator at the instance of the direction issued by this Court. The petitioner and the defacto complainant are present through video conference. The learned counsels representing them are present before this Court today, circulated the Joint Memo of Compromise entered between them.

The learned counsels as well as the parties expressed that they have settled their dispute and therefore no further investigation bas to be done by the respondent police on the complaint given by the 2nd respondent/Sivasankari.

This Court taking note of the settlement arrived between the parties hereby directed the petitioner and the 2nd respondent, defacto complainant to appear before the Investigating Officer in person or through their counsel and submit the copy of the Joint Memo of Compromise and withdraw the complaint. It is stated that the defacto complainant is living abroad. If it is so, the notarised affidavit may be produced before the Investigating Officer. Recording the same FIR can be closed and report to the concerned jurisdictional Magistrate.

With the above directions, this Criminal Original Petition to quash is disposed of.
