ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(2), 319(2), 308(4) and 351(3) of BNS, 2023, in Cr.No.367 of 2025 seeks anticipatory bail.

2.The allegation against the petitioner is that the petitioner is arrayed as A6 in this case and was engaged in transporting A1 to A4, who impersonated police officers and robbed a sum of Rs.3,00,000/- from the defacto complainant, as part of a child adoption racket.

3.The learned counsel for the petitioner submitted that the petitioner was present at the place of occurrence. However, while the other accused have been arrested, the petitioner has not been arrested, as he was unaware of the intentions of the other accused. It is further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent police reiterated the prosecution case and submitted that while A1 and the defacto complainant were exchanging money for the purpose of adopting a child, the other accused, posing as police officers, intervened and snatched a sum of Rs.3,00,000/-. The petitioner drove the car in which the other accused travelled in police uniform. Hence, she opposed for the grant of anticipatory bail to the petitioner.

5.I have also gone through the statement recorded from the arrested accused and it revealed that the petitioner is also actively participated in the offence and was aware that the persons travelling with him were not police officers, despite transporting them. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
