This Petition has been filed to condone the delay of 55 days in filing the petition to restore A.S.No.604 of 2011.

2.Heard the learned counsel for the Respondent.

3.By an earlier order dated 14.02.2024, this Court observed as follows:

"If the Petitioner fails to make payment to the Respondent, this appeal suit will be disposed of on merits"

4.Ms.Radhika, learned counsel for Mr.L.Muralikrishnan, learned counsel for the Respondents 2, 4 to 8 would submit that the earlier order passed by this Court on 14.02.2024 is not complied with. Hence, this Civil Miscellaneous Petition is dismissed.
