Heard Mr.A.L.Somayaji, learned Senior Counsel appearing on behalf of the fourth respondent. He has filed an affidavit as an additional information, where the fourth respondent has stated that the fourth respondent himself is a manufacturer of the System, i.e. Safety Roller Barrier System and that system alone has been installed on trial run basis to the extent of 60 meters in the contract site and when the system has been sent for testing, i.e. MASH TL 4, the result for the same has come in September, 2021, where certificate to that effect has been issued, which has already been produced before this Court.

2. Therefore, the stand now taken by the fourth respondent is that, what has been manufactured by the fourth respondent is the system developed by them which has been installed for 60 meters and that has been tested and a testing certificate also has come and therefore, absolutely there could be no quarrel on the safety aspects.

However, Mr.Karthik Sundaram, learned counsel for the petitioner would contend that it is the first time a stand has been taken by the fourth respondent that the system has been developed by themselves and in this regard, after verifying the same, if any contra evidence is available, after getting instructions from the petitioner, that would be produced before this Court and he wants to get along with the case thereafter.
