This Application has been filed to condone the delay of 253 days in filing the above captioned C.M.A against the decree and judgment passed in MCOP.O.P.No.1124 of 2019, dated 14.08.2021 on the file of the Motor Accident Claims Tribunal Cum Subordinate Judge, Salem. 2.Learned counsel for the appellant submitted that notice to the 1st respondent was dispensed with vide Court order, dated 13.06.2023. In spite of notice being served on the 2nd respondent, he had neither chosen to appear in person nor through his counsel.

3.Heard the learned counsel for the petitioner. 4.Considering the averments made in the affidavit filed in support of this application and being satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for. 5.Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
