Petitioners PRAYER: Original Petition filed for Succession Certificate under Section 372 of Indian Succession Act, 1925 under Order XXV Rule 6 of Original Side Rules, prays that a Succession Certificate in favour of the petitioners herein for the transmission of the said securities that had hitherto been held by the petitioners' uncle late SriRamakrishna which are more fully described in the schedule annexed hereto.

ORDER

The petitioners seek Succession Certificate in respect of the securities held by C.Ramakrishna, who died intestate on 30.05.2021. The petitioners are the Class II legal heirs, as all his Class I legal heirs had pre deceassed him, and he remained unmarried till his death. The 1st petitioner is the daughter of late sister Rajalakshmi Kandaswamy and the 2nd petitioner is the daughter of late brother C.Vedachalam Mudaliar, and the third petitioner is 1/6

the daughter of late brother C.Muthukumaraswamy Mudaliar of the deceased C.Ramakrishna.

2. The 2nd petitioner has been examined as P.W.1. She has produced the death certificate of the deceased C.Ramakrishna, as Ex.P1, and the legal heirship certificate of the deceased C.Ramakrishna as Ex.P2. A perusal of Ex.P2, shows that the petitioners are the only surviving Class-II legal heirs of the deceased C.Ramakrishna. A paper publication has been made and no objections have been received.

3.In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioners for the grant, in respect of the securities mentioned in the schedule to the petition. 23.03.2023 Index :Yes/No Speaking : Yes/ No 2/6
